End User License Agreement (EULA) - PacketPlanner (Windows)

1. Agreement

By downloading, installing, or using PacketPlanner on Windows through the Microsoft Store, you agree to these terms. If you do not agree, do not install or use the App.

2. License

We grant you a personal, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes on your Windows device(s).

3. Paid Application with Free Trial

The Windows version of PacketPlanner is a paid application with a free trial period managed by Microsoft Store.

3.1 Free Trial Period

• Microsoft Store may offer a free trial period as configured in the Store listing
• During the trial period, you have full access to all features
• Trial period duration is determined by Microsoft Store settings
• You can use the app fully during the trial without any payment

3.2 Purchase After Trial

• After the trial period ends, you must purchase the app to continue using it
• This is a one-time purchase (not a subscription)
• Payment: Charged to your Microsoft Account at confirmation of purchase
• Price: As displayed in the Microsoft Store (subject to change and regional pricing)
• License: Valid for use on all your Windows devices signed in with the same Microsoft Account

3.3 All Features Included

The Windows version includes all features unlocked by default:

• Unlimited groups (no restrictions)
• Full trip planning and itinerary management
• Export to Excel, Spreadsheet, CSV, and PDF formats
• Data backup and restore functionality
• No advertisements
• No in-app purchases

There are NO additional in-app purchases or subscriptions required.

4. Refunds

Refund requests are handled directly by the Microsoft Store in accordance with their refund policies. We do not have the ability to process refunds directly.

To request a refund:

1. Visit https://account.microsoft.com/billing/orders
2. Find your PacketPlanner purchase
3. Request a refund within Microsoft’s refund window

5. Data & Privacy

All your data is stored locally on your Windows device. We do not collect, transmit, or store any of your personal information on external servers.

• Local Storage: Your recipient lists, itineraries, settings, and calculator data are stored using Windows local storage APIs
• No Cloud Sync: Data does not synchronize across devices or upload to any cloud service
• Data Location: %LocalAppData%\Packages\MLOGICTECH.PacketPlanner_[hash]\LocalState

6. No Advertisements

The Windows version does not display any advertisements. Your experience is completely ad-free.

7. Updates

We may release updates to the App through the Microsoft Store. Updates may:

• Add new features
• Improve performance and stability
• Fix bugs and security issues
• Modify or remove features

By continuing to use the App after an update, you accept any changes to these terms.

Automatic Updates:

• Microsoft Store may automatically update the app based on your Windows settings
• You can manage automatic updates in Windows Settings

8. System Requirements

• Operating System: Windows 10 version 17763.0 or higher
• Architecture: x64
• Storage: Approximately 100 MB available space
• Internet: Required for initial download and license validation; app works offline after installation

9. Disclaimer (“As-Is”)

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

We do not guarantee that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App will be compatible with all hardware or software configurations
• Data loss will not occur

Use at Your Own Risk: You assume all risk associated with using the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Modern Logic Tech Solutions (MLOGICTECH) SHALL NOT BE LIABLE for any indirect, special, incidental, consequential, or punitive damages arising out of or related to your use or inability to use the App
• This includes but is not limited to:
  • Loss of data or information
  • Loss of profits or revenue
  • Business interruption
  • Cost of substitute goods or services
  • Failure to meet any duty
• Maximum Liability: Our total liability for any claims under these terms shall not exceed the amount you paid for the App

11. Backup Responsibility

While the App provides backup/export functionality, you are solely responsible for backing up your data. We recommend:

• Regularly exporting your data using the built-in export features
• Saving exported files to a secure location (cloud storage, external drive, etc.)
• Testing your backups to ensure they can be restored

We are not liable for any data loss.

12. Termination

12.1 Your Right to Terminate

You may stop using the App at any time by uninstalling it from your Windows device.

12.2 Our Right to Terminate

We reserve the right to:

• Discontinue the App at any time
• Revoke your license if you violate these terms
• Suspend access for security or legal reasons

12.3 Effect of Termination

• Your license to use the App ends immediately
• You must uninstall the App from all devices
• Refunds are subject to Microsoft Store policies
• All local data remains on your device until you delete it

13. Intellectual Property

• The App, including all content, features, and functionality, is owned by Modern Logic Tech Solutions
• All trademarks, logos, and service marks are our property
• You may not copy, modify, distribute, sell, or reverse engineer the App
• You may not remove or alter any copyright notices

14. Governing Law

These terms are governed by the laws of Malaysia, without regard to conflict of law principles.

Any disputes arising from these terms or your use of the App shall be resolved in the courts of Malaysia.

15. Changes to These Terms

We may update these terms from time to time. Changes will be effective when:

• We update the “Last Updated” date at the top of this document
• You continue using the App after the changes

Your Responsibilities:

• Review these terms periodically
• Stop using the App if you do not agree with changes

16. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Modern Logic Tech Solutions regarding the App.

These terms supersede any prior agreements or understandings.

18. Microsoft Store Terms

Your use of the App is also subject to the Microsoft Store Terms of Use: https://www.microsoft.com/en-us/servicesagreement

In case of conflict between these terms and the Microsoft Store Terms, the Microsoft Store Terms shall prevail.
